I'd say it matters because (apart from copyright theft) the suit you pay for and receive isn't going to be that you see in the advertisement.

Again, it's not about buying the suit, but about the idea behind the suit and promotion photos. In other words, I'm talking about the photos only, disconnected from anything legal, manufacturing, commercial, copyright, etc.
